1. About this Privacy Policy
AK22 Digital Marketing (“AK22”, “we”, “us” or “our”) provides digital marketing, advertising, search, content, website, automation and media services. We are committed to handling personal information responsibly, transparently and securely.
This Privacy Policy explains how we collect, hold, use and disclose personal information when you:
- visit or interact with our website;
- submit an enquiry, contact form or booking request;
- use our website assistant or automated website tools;
- use our SEO Health Checker or request an SEO report;
- subscribe to communications;
- communicate with us by email, telephone, social media or another channel;

- otherwise deal with AK22 as a client, prospective client, contractor, supplier or business contact.
Where applicable, we handle personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and other applicable Australian laws. Some small businesses may be exempt from parts of the Privacy Act; regardless of whether an exemption applies, AK22 aims to follow the practices described in this policy.
This policy does not form part of any employment or service contract. Additional privacy notices may apply to particular forms, tools, projects or services.
2. What is personal information?
Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. Depending on the circumstances, a business email address, telephone number, website submission, online identifier, image, voice recording or other business-related information may be personal information.
3. Personal information we may collect
The information we collect depends on how you interact with us and the services involved. It may include:
Contact and identity information

- business address;

- website content, brand assets, photographs, videos, audio, testimonials and other project materials;
- contracts, invoices, transaction details and payment records; and
- information needed to provide support, maintenance, reporting or optimisation.
AK22 does not intend to store complete payment-card details. If electronic payment facilities are used, payment information may be processed by a third-party payment provider under its own privacy terms.

SEO Health Checker information
When you use our SEO Health Checker, we may collect:
- your name and business name;
- the website URL submitted for assessment;
- your email address and, if supplied, telephone number;
- your consent and contact preferences;
- the automated test results, score and technical findings;
- the date and time of the request; and
- security, usage and rate-limiting information, which may include an IP address.
You should only submit a website that you own, manage or are otherwise authorised to assess. The SEO Health Checker examines information that is publicly accessible from the submitted website and, where configured, information returned by third-party performance or analysis services.
Website assistant (Ask AK22) information
If you use our website assistant (“Ask AK22”), the questions you type are processed on our website to find an approved answer. We do not record full conversations, and the assistant does not use cookies or artificial intelligence; your conversation is kept in your browser only for your current browsing session. If the assistant cannot answer a question, a shortened copy of that question (with email addresses, phone numbers and the query part of any web addresses removed) may be kept for up to 180 days so we can improve our answers. We also keep anonymous daily usage totals and, to help prevent misuse, use a temporary, non-reversible code derived from your IP address that expires within about an hour and is never stored with your questions. If you choose to send us a message through the assistant, we collect the name, email address and message you provide, any optional details you add (phone number, business name and service of interest), your consent, the page you sent it from and the time it was sent; these messages are currently kept for up to 12 months. You should not submit passwords, payment-card information, health information, government identifiers or other sensitive information through the assistant.
Images, audio and video
For content creation and drone photography or video services, we may collect or create photographs, video footage, audio recordings and related production information. These materials may include identifiable people, voices, locations, vehicles or property. Where required, AK22 or the relevant client will obtain appropriate permissions or releases for the intended collection and use.
4. Sensitive information
AK22 does not ordinarily need to collect sensitive information, such as health information, biometric information, political opinions, religious beliefs, sexual orientation or criminal-record information.
Please do not provide sensitive information unless we have specifically requested it and explained why it is required. Where applicable, we will obtain consent before collecting sensitive information unless collection is otherwise permitted or required by law.
5. How we collect information
We may collect personal information:
- directly from you through forms, the SEO Health Checker, our website assistant, email, telephone, video meetings, in-person meetings, surveys or social media;
- from a client, employer, colleague or authorised representative involved in a project;
- through our website, analytics, cookies, advertising pixels and security tools;
- through advertising, analytics, social media, content management, email marketing, automation and other platforms used for an authorised project;
- from publicly available sources, including business websites, directories, search engines, social media pages and public registers; and
- from contractors, suppliers, referral partners or other third parties where they are authorised to provide the information.
If you provide personal information about another person, you must have authority to do so and, where required, make them aware of this policy and the relevant collection notice.
6. Why we collect, use and disclose information
We may collect, use and disclose personal information to:
- respond to enquiries and communicate with you;
- assess your requirements and recommend relevant AK22 services;
- arrange consultations, meetings and bookings;
- prepare proposals, scopes, contracts and estimates;
- onboard clients and administer our business relationship;
- provide, manage and improve our services;
- create, run, measure and optimise advertising or marketing campaigns;
- conduct website, SEO, AEO, analytics, content, email, automation and user-experience work;
- perform a requested SEO Health Check and provide the resulting report;
- operate and improve our website, forms, website assistant and other tools;
- provide support, maintenance, reporting and account administration;
- process invoices and maintain business, accounting and tax records;
- obtain feedback, testimonials and case-study approvals;
- detect fraud, spam, misuse, security threats or technical problems;
- comply with legal, regulatory, insurance and contractual requirements;
- establish, exercise or defend legal claims; and
- send direct marketing where you have consented or where otherwise permitted by law.
Where practical, we will explain the purpose of collection at the point where information is collected.
7. Our services and handling of client data
AK22 may handle personal information while providing the following services:
Google Ads and paid search
We may access advertising accounts, campaign data, conversion data, audience information, search-query information, billing profiles and analytics information as authorised by the client. Data is used to plan, deliver, measure and optimise campaigns.
Facebook and social media marketing
We may access Meta or other social media business accounts, pages, advertising data, audience settings, engagement information, messages and conversion information. Where a client supplies a customer list or directs us to create a custom audience, the client is responsible for ensuring it has the necessary authority, notices and consents.
Search Engine Optimisation and Answer Engine Optimisation
We may analyse websites, public search results, analytics, search-performance information, technical configurations, content, structured data and competitor information. If clients provide access to analytics or search-console accounts, we use that access only for authorised work.
Email marketing
We may handle subscriber names, email addresses, segmentation information, consent status, campaign activity and unsubscribe information. Clients must only provide contact lists that they are lawfully permitted to use. AK22 does not purchase or knowingly use unlawfully obtained mailing lists.
Content creation
We may collect or create written content, images, video, audio, interviews, testimonials, brand materials and production records. We will use these materials for the agreed project and any additional approved use.
Automation and AI-agent services
We may process workflow information, form submissions, customer enquiries, prompts, outputs and integration data to design or operate authorised automations. We take reasonable steps to minimise the personal information supplied to AI or automation providers and to apply human review where appropriate. Clients must not instruct AK22 to process personal information through an automation or AI service unless they have authority to do so.
Website design, user experience and development
We may access website content, user submissions, analytics, hosting settings, domain settings, administrative accounts, databases, integrations and security information. Access is limited to what is reasonably required for the agreed work.
Drone photography and video
Drone work may capture people, property, vehicles, locations or activities. AK22 will conduct work subject to the agreed brief, applicable operational requirements and any required permissions. Clients are responsible for identifying private locations, restricted information or people who should not be recorded where this is within their knowledge or control.
8. Automated tools, artificial intelligence and decision-making
AK22 may use artificial intelligence, automation and software tools to assist with research, analysis, drafting, content production, reporting, campaign management, customer support and business administration.
These tools may process limited information through third-party systems. We seek to avoid submitting sensitive or unnecessary personal information and use reasonable human oversight for material client work. AI-generated output may be incomplete or inaccurate and is reviewed according to the nature and risk of the task.
Our public SEO Health Checker produces an automated preliminary score. It is not a complete professional SEO audit, does not determine a person’s eligibility for a service and does not make decisions that have legal or similarly significant effects on individuals.
Our website assistant (“Ask AK22”) is a rule-based tool that answers questions only from information AK22 has prepared and approved. It does not use artificial intelligence and does not send your questions to third-party AI services. Your conversation is kept in your browser only for your current browsing session so it can continue across pages, and we do not record full conversations. If the assistant cannot answer a question, a shortened copy of that question — with email addresses, phone numbers and the query part of any web addresses removed — may be kept for a limited period (currently up to 180 days) so we can improve our answers, together with daily usage totals that do not identify you. If you send us a message through the assistant, we handle the details you provide in the same way as other website enquiries. Assistant responses are general information only and should not be treated as legal, financial or other professional advice.
9. Cookies, analytics and advertising technologies
Our website may use cookies, pixels, tags, local storage and similar technologies to:
- keep the website secure and functioning;
- remember preferences;
- understand website traffic and visitor behaviour;
- measure forms, enquiries and advertising conversions;
- improve website content and performance; and
- support advertising and remarketing where enabled.
These technologies may be provided by third parties, including analytics, advertising, social media, hosting and security providers. They may collect device identifiers, IP addresses, page-view information and interaction data, and may process information outside Australia.
You can manage cookies through your browser settings. Disabling some cookies may affect website functionality. Where required, we will provide additional choices or consent controls for non-essential technologies.
10. Direct marketing
Where you have consented, or where otherwise permitted by law, AK22 may send information about services, insights, offers or events by email, SMS, telephone or another agreed channel.
You can unsubscribe from electronic marketing by using the unsubscribe facility in the message or contacting us. We may retain a minimal suppression record to ensure we respect your request. Withdrawing marketing consent does not prevent us from sending service communications that are reasonably necessary to respond to a request, provide contracted services, deliver a requested report or administer an existing relationship.
Submitting an enquiry, using the website assistant or requesting an SEO check does not automatically subscribe you to ongoing promotional communications. Where marketing consent is requested, it will be presented separately from consent needed to provide the requested service.
11. When we disclose information
We may disclose personal information where reasonably necessary to:
- our employees and authorised contractors;
- website hosting, cloud storage, backup, security and content-delivery providers;
- email, SMTP, communications and video-meeting providers;
- customer relationship management, form, booking and project-management providers;
- analytics, search, advertising and social media platforms;
- email marketing and marketing automation platforms;
- AI, transcription, content and automation providers;
- website, domain, software and technical-support providers;
- payment, accounting, banking, insurance and professional advisory providers;
- a client or authorised project stakeholder where the information relates to their project;
- regulators, courts, government agencies or law-enforcement bodies where required or authorised by law;
- parties involved in an actual or proposed sale, restructure or transfer of our business, subject to appropriate confidentiality arrangements; or
- another party with your consent or at your direction.
We do not sell personal information.
Each third-party provider has its own privacy practices. Where practical, we select reputable providers and limit the information disclosed to what is reasonably necessary for the service.
12. Overseas processing and disclosure
Some technology providers used by AK22 may store or process information outside Australia. This may include providers operating in the United States and other countries in which their data centres, related companies or service providers are located.
The countries involved may change as providers and hosting arrangements change. Where required and reasonably practicable, we will take steps to ensure overseas recipients handle personal information consistently with applicable Australian privacy requirements. You can contact us for current information about material overseas service providers relevant to your interaction with AK22.
13. Security
We take reasonable administrative, technical and physical steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure. Depending on the information and system, these measures may include:
- access controls and role-based permissions;
- password management and multi-factor authentication where available;
- encryption in transit and security certificates;
- website, software and plugin maintenance;
- backups, logging, spam protection and malware or firewall tools;
- limiting contractor and provider access;
- confidentiality obligations; and
- deletion, de-identification or removal of access when no longer required.
No internet transmission or storage system is completely secure. You should not send confidential credentials or sensitive information through ordinary email, website forms or the website assistant unless we have agreed on an appropriate secure method.
14. Retention and deletion
We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including to provide services, manage relationships, resolve disputes and satisfy legal, accounting, tax, insurance and contractual requirements.
Retention periods vary according to the type of information. For example:
- enquiry, website assistant and SEO-checker information may be retained while we respond, assess service interest and maintain reasonable business records;
- client project, campaign, approval, invoice and contract records may be retained for the relationship and any legally required period;
- marketing-contact information may be retained until consent is withdrawn or the information is no longer needed; and
- technical, security and analytics records may be retained according to operational needs and provider settings.
When information is no longer reasonably required, we take reasonable steps to delete it or de-identify it, unless retention is required or authorised by law. Backup copies may remain for a limited period until overwritten through normal backup cycles.
15. Access and correction
You may request access to personal information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading.
To make a request, contact us using the details at the end of this policy. We may need to verify your identity before responding. In some circumstances, applicable law may permit or require us to refuse access. If so, we will explain the reason where it is lawful and reasonable to do so.
16. Withdrawal of consent and deletion requests
Where we rely on consent, you may withdraw it by contacting us. Withdrawal does not affect processing that occurred before consent was withdrawn and may affect our ability to provide a requested service.
You may also ask us to delete personal information. We will consider the request and delete or de-identify information where reasonably practicable, subject to legal, security, contractual, dispute-resolution and record-keeping requirements.
17. Anonymised and aggregated information
We may create and use aggregated or de-identified information for reporting, service improvement, security, research and business planning. We will take reasonable steps to ensure this information does not identify an individual.
18. Third-party websites and services
Our website may contain links to third-party websites, booking systems, social media platforms or other services. AK22 is not responsible for the privacy practices or content of independent third parties. You should review their privacy policies before providing personal information.
19. Children and young people
AK22’s website and services are primarily directed to businesses and adults. We do not knowingly seek personal information directly from children. If you believe a child has provided personal information without appropriate authority, please contact us so that we can review and, where appropriate, delete it.
20. Data breaches
If AK22 becomes aware of a suspected data breach, we will take reasonable steps to contain and assess it. Where the Notifiable Data Breaches scheme or another applicable law requires notification, we will notify affected individuals and the Office of the Australian Information Commissioner as required.
21. Privacy complaints
If you have a question or complaint about how we handle personal information, contact our Privacy Contact using the details below. Please provide enough information for us to understand and investigate the matter.
We will acknowledge and respond within a reasonable period. If you are not satisfied with our response and the Privacy Act applies, you may be able to contact the Office of the Australian Information Commissioner at https://www.oaic.gov.au/.
22. Changes to this policy
We may update this Privacy Policy when our services, systems, providers or legal obligations change. The current version will be published on our website with its effective date. Material changes may also be communicated through an appropriate additional notice.
